These Terms apply to all users of the Site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our Site. If you do not agree to all the Terms, then you may not access the Site or use any services.

2. User Accounts

To access certain features of the Site, you may need to register for an account. You agree to provide accurate, complete, and current information during the registration process. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

3. Product Information and Pricing

We make every effort to display the colours and images of our products as accurately as possible. However, we cannot guarantee that your device's display of any colour will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

Please note that due to the handcrafted and artisanal nature of our brass statues, minor variations in finish, colour tone, and dimensions may exist between individual pieces. These variations are a mark of authenticity and not a defect.

4. Orders, Payment, and Shipping

Order Acceptance:

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason at any time after receiving your order.

Payment:

We accept payments via Ccavenue, Razorpay, and major credit/debit cards, UPI, and Net Banking. You agree to pay for the products and services you purchase through our Site. All transactions are processed securely in Indian Rupees (INR).

Shipping:

We will ship to the address provided by you. Shipping costs and delivery times are an estimate and may vary. We are not responsible for delays caused by the courier or for incorrect addresses provided by the customer. Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. For more details please refer to our Shipping Policy.

5. Returns, Refunds, and Replacements

Returns:

Due to the handcrafted and unique nature of our products, we do not accept returns. All sales are considered final. Please refer to our Returns Policy section for more details.

Replacements:

We understand that products may sometimes be damaged during transit. Replacements are possible only for goods that are reported as damaged upon arrival. Any such issues must be reported to our customer service team within 5 days of receiving the product. We reserve the right to request proof of damage, such as photos or videos, to process the replacement. Replacements are subject to product availability.

Mandatory Evidence: To process a replacement, you must provide an uncut and unedited package opening video. This allows our quality team to verify damage occurred during mishandling or transit.

Cancellations:

Orders may be cancelled within 12 hours of placement. After this period, the order may have already been processed and cannot be cancelled. To request a cancellation, please contact us immediately at shop@yashrahomes.com.

6. Intellectual Property Rights

All content on this Site, including product images, text, logos, and the Site's design, is the intellectual property of MS Yashra Homes and is protected by Indian and international copyright and trademark laws. You may not use, reproduce, or distribute any content from the Site without our express written permission.

Specifically, you are prohibited from:

• Reproducing or copying any product images or descriptions for commercial use.

• Using our brand name, logo, or trademarks in any manner that may cause confusion.

• Creating derivative works based on our Site content without prior written consent.

7. Disclaimers and Limitation of Liability

In no event shall MS Yashra Homes, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from:

8. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Meerut, Uttar Pradesh, India.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes. We encourage you to review these Terms periodically.
